BETA Competition Terms and Conditions
This competition is owned, maintained and managed by rightBETA.com.
Here are the full terms and conditions for all rightBETA.com competitions. Please read these carefully before entering one of our competitions.
By entering a competition published by rightBETA.com, the participant agrees to the terms and conditions set out here. These terms and conditions and any terms and conditions set out in the competition advertisement or promotional material are referred to as the “BETA competition rules”.
In these rules, the term “competition(s)” includes email promotions, mobile-based competitions and web based promotions. “Participant(s)” means any person taking part in our competition.
1. Unless otherwise stated in a competition advertisement, the promoter of all competitions contained on this website is rightBETA.com. (the “promoter”).
Eligibility of participants.
2. To enter a competition all participants must comply with the entry requirements stated in that competition advertisement and/or promotional material. The participant acknowledges that failure to comply with the rules may result in his or her disqualification from the competition.
3. Unless otherwise stated, entry to all competitions is restricted to participants who are residents of Sri Lanka and 18 years of age or over.
4. Employees of rightBETA.com or their agents or members of their immediate families are not eligible to enter any competition.
5. If a promoter other than rightBETA.com is referred to in a competition advertisement as the promoter of the competition, employees of that specified promoter or its associated companies or their agents or members of their immediate families are not eligible to enter that competition.
6. The promoter has the right at any time to require participants to provide proof of identity and/or eligibility to enter the competition. If a participant is required to provide such evidence and fails to do so, the promoter may decide to disqualify a participant from the competition or withdraw a prize.
7. When requested, the participant must provide full, truthful and accurate information to requests for evidence of eligibility to participate and must not mislead the promoter.
8. Names of winners and results of competitions can be obtained by sending a pre-stamped envelope stating date and prize to Competitions Department, rightBETA.com, the address of which can be found on our general terms and conditions page.
9. No correspondence will be entered into about a decision regarding eligibility.
10. Unless otherwise stated, entries must be received by the promoter no later than the published closing date for the competition.
11. Proof of sent SMS (“short messaging service”)/text message or emails will not be accepted as proof of receipt of entry by the promoter and no responsibility is accepted by the promoter for entries lost, delayed, mislaid or for any technical failure or for any event which may cause entries to the competition to be delayed, deleted, misdirected, disrupted or corrupted.
12. The promoter is not responsible for incomplete, unclear, incomprehensible or distorted entries. Such entries will be void.
Method of Participation and Payment to Enter
13. Where a participant uses a pay-to-enter route for a competition each entry must be accompanied by the appropriate entry fee.
14. Where the selected method of entry is by premium rate SMS/text message:
• The competition entry fee payable to rightBETA.com for sending the SMS/text message will be set out in the competition advertisement or promotional material.
• Participants should note that the final cost of the SMS/text message to the participant may vary and will depend on the participant’s agreement with his or her network provider.
15. Where the selected method of entry is postal entry:
• Postal entrants may enter a competition by sending a postcard or an envelope with their answer, full name, postal and/or e-mail address and a contact telephone number to the postal address indicated in the competition information.
• Where indicated in the competition information, the will include a competition identification code. RightBETA.com reserves the right to disqualify entries if the entry does not include the identification code if necessary.
• Each postal entry must bear its own stamp but rightbETA.com makes no additional charge for postal entries. Any postal entry received which does not bear the correct paid postage will be invalid and will not be entered into the competition.
• Entries sent by post must be delivered by the specified closing date for entries. Postal entries are deemed to be received upon arrival at the postal address indicated in the competition information.
• RightBETA.com does not accept responsibility for any incorrectly addressed or undelivered entries or for any disruption, delay or misdirection of postal entries.
• In the event that there are substantial disruptions or delays to postal services for reasons beyond the entrants’ and/or rightBETA.com’ control, for example due to postal strikes, we reserve the right (but is under no obligation) to postpone the closing date for postal entries at its sole discretion.
16. The promoter is not responsible if the SMS/text message entry made by the participant is disrupted, unclear, distorted, undelivered, delayed or affected in any way beyond the reasonable control of the promoter or any third party employed by the promoter to administer competition entries. The promoter is not liable for any charges incurred by the participant for any such telephone call, Internet connection, SMS/text message, MMS/video message/photo message or e-mail.
Change of Rules
17. RightBETA.com reserves the right, acting reasonably, to change the rules applicable to any competition or to void any competition at any time and for any reason. In the unusual event that a competition is declared void for any reason, rightBETA.com will attempt to refund all participants, subject to the participant providing proof of payment of the entry fee if applicable.
Prizes
18. There is no cash alternative to the prizes and prizes may not be substituted for other prizes, unless specifically stated in the competition advertisement or promotion. RightBETA.com offers prizes subject to availability and reserves the right to substitute prizes for a similar item of equal or higher value if the stated prize is not available.
19. Unless otherwise specified, prizes may take up to 8 weeks to be delivered. Winners shall be notified by email or telephone unless otherwise stated.
20. Participants are responsible for paying all srilankan taxes, duties and any other levies on prize winnings if applicable.
21. If the winner of a competition informs the promoter that he or she is unable to take up a prize for any reason, the promoter reserves the right to award it to an alternative winner, in which case the first winner chosen will not be eligible for any share of the prize whatsoever.
Publicity of Winning Entries
22. The participant agrees to his or her name and other relevant details being published in connection with a winning entry in the competition and agrees to the promoter disclosing his or her details on the promoter’s website and to any individual requesting the name of the winning participant.
23. The participants agree not to enter into correspondence or give interviews with any person other than the promoter on any matters arising from any competition without the prior written permission of rightBETA.com.
24. The participant agrees to co-operate with the promoter including its photographers or reporters to publicize their win as rightBETA.com deems reasonably requires.
25. The promoter is not under any obligation to publish any competition entries supplied.
Participants’ Obligations and Editors’ rights.
26. The participant confirms that:
• He or she has the right to submit the competition entry in accordance with the rules of entry;
• All entries submitted by the participant are legal, and truthful and comply with all applicable laws, regulations, standards or codes of practice;
• All entries submitted do not infringe copyright, design, privacy, publicity, data protection, trademark, or any other rights of any third party willingly or unwillingly and with knowledge or without knowledge;
• All entries do not contain any abusive, obscene, threatening or defamatory material.
27. The participant has sole responsibility for his or her entries and each participant agrees to indemnify the promoter and keep the promoter fully and effectively indemnified on demand from and against all actions, claims, losses, liability, proceedings, damages, costs, expenses, loss of business, loss of profits, business interruption and other pecuniary or consequential loss (including legal costs and expenses) suffered or incurred by the promoter and/or rightBETA.com and arising directly or indirectly out of the publication of any competition entry submitted by the participant.
28. Failure to comply with any of these rules may result in the disqualification of the entry.
Limitation of Liability
29. To the fullest extent permitted by law, the promoter accepts no liability for any loss or damage of any nature whatsoever and howsoever arising out of or in connection with a participant’s entry into the competition (including the use of any prize) and the promoter’s use of the entry whether due to inaccuracy, error, omission or any other cause and whether on the part of the promoter (or its servants, agents or any other person or entity).
30. To the fullest extent permissible by law, the promoter does not make any express or implied warranties, representations or endorsements whatsoever with regard to the competition prizes or any information, service or product provided in connection with a competition.
Participants from outside Sri Lanka
31. Unless otherwise stated, all competitions are operated by the promoter from its offices in Sri Lanka.
32. All competitions are open to Sri Lankan residents only.
General Provisions
33. If any provision or term of these rules shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be divisible from the rest of the rules and shall be deemed to be deleted from them.
34. Any failure or delay by the promoter in enforcing an obligation or exercising a right, under these rules, does not amount to a waiver of that obligation or right or any other obligation or right.
35. The participant acknowledges that he or she has not agreed to these rules in reliance on any statement or representation, except in so far as the representation has been incorporated into these rules. The participant irrevocably and unconditionally waives any right the participant may have to claim damages and/or to rescind these terms and conditions by reason of any misrepresentation (other than a fraudulent misrepresentation) not contained in these terms and conditions.
36. These rules and all competitions included in the publications are governed by and construed in accordance with the English Law and the Sri Lankan Courts will have exclusive jurisdiction to determine any proceedings in connection with this competition.
